so my kid was out back playing and went in the back to get a ball that went over the fence.. long story short
guys dog gets out jumps the fence and attacks my kid..
fucked his leg up prett good... i took he right to the hospital and tried to call animal control they were closed..
so i called 911 to report it and they got someone at animal control to call me
what can i do to get this dog taken away so it dont happen again?

would you go all out and sue the shit out of them if this happed to your kid?
the dog is always getting out the yard jumping the fence and opening the gate.. they are trying to get the dog aggressive so i was told by someone that goes to there house....
it would have been worst if we didnt get the dog off him

I would walk over to their yard and put a bullet in the dog's head. Sorry but any dog that harms a human needs to be put down, plain and simple. I'm totally against animal cruelty but when the animal is the one being cruel it's completely different.

Just to put this out there, it's not the dogs fault. The blame shifts to the owner. Yes the dog is the one that bit your kid, and I understand. The issue is with the owner. I would sue him, and have his dog taken away. Dogs only do what they are taught.

Hope your kid is okay.

Edit: Let me edit here as by sueing him, I meant just like everone else said. For the medical costs. Not just to go after him.

yeah i would start to conceal carry and next time that thing gets out of the yard and comes toward you and your child put a couple of rounds in its head. you and your childs life is being threatened, so self defense is needed. you'll probablly spend too much money on court costs and lawyer fee's and if you were to win a civil case could your neighbor even afford to pay any kind of money towards all of this???

Call the cops and take care of things the legal way. Killing the dog in retaliation is not going to help anyone. All it will do is land your ass in court. Now with that said, I would carry a knife or gun. If the dog comes aggressively at you put his ass down. Missouri castle doctrine extends to the front and back yard so you wont need a CCW to shoot the dog.

That is an EXCELLENT way to end up in jail, or with the dog owner shooting you.

If the OWNER is trying to make the dog aggressive then I would report that as well as the dog bite. Killing ones dog will only cause more problems. Maybe for the time being keep your kid inside or go to a park to play, I know it's not fair for your kid but until the situation gets resolved it's probably the better thing to do. I know the area I live they take dog bits very serious, hopefully they do the same with this.

im pretty sure i would have murdered the dog, if i was the one to pull it off of my kid. in your situation, if the cops or animal control dont do anything, get it to attack you, let it bite you a few times then break its neck. just make sure you arent on the dog owners property.

wow i hit the wrong button and erased my whole story that i was typing so here is the cliiffs.

-got bit by a dog when i was younger in the face.
-that incident developed my fear of blood and going to the hospital.
-my injuries were not nearly severe as your kids. just some stiches.
-my dad sat me down explained to me it wasnt my fault, the dog was just doing what its internal instincts were to protect his area. whether or not it was the owners neglegence or not.
-we didnt sue or anything like that as my dad just chalked it up as an accident and bad luck.

now with all that said what i would do and this is just me, also understand i am not a parent. i would go to the owner with your kid and ask for him to pay any medical expenses, due to it being his dog in your yard. now that is just asking, its not a forceful situation or you wont get anywhere (you bring your kid because you want to assure the kid that you are there father and you are taking care of the situation). now i say you should ask and not force him to pay because what i believe is you are the parent and should be able to take care of your son bills/insurance yadda yadda. i would not go after killing the dog as from what my dad explained it is just a dog it had no intent but the intent to do what it was trained/put on this earth to do. but most importantly inform him to not mistake your calm attiutude for weakness as if this situatuion was to ever show itself again the dog will be put down by your hands and that you both agree along with the authorites that it will be justified. most importantly make sure your kid is all right, let them know everything will be ok and dads taken care of it as this may not look like much put it really is a tramatic life changing expreience. best thing i remember about what happened to me as my dad took me to get ice cream after it happened. hope this helps.
