Even on fda website it says its issued letters to the companies, but nothing about a ban yet.
The U.S. Food and Drug Administration today warned four companies that the caffeine added to their malt alcoholic beverages is an “unsafe food additive” and said that further action, including seizure of their products, is possible under federal law
"The agency said the products named in the Warning Letters are being marketed in violation of the Federal Food, Drug, and Cosmetic Act (the FFDCA). Each Warning Letter requests that the recipient inform the FDA in writing within 15 days of the specific steps that will be taken to remedy the violation and prevent its recurrence. If a company does not believe its products are in violation of the FFDCA, it may present its reasoning and any supporting information as well.
If the FDA believes that the violation continues to exist, the agency may pursue an enforcement action that could include seizure of the products or an injunction to prevent the firm from continuing to produce the product until the violation has been corrected"

From CNN.com
Thus far, Michigan, Oklahoma, New York, Washington and Utah have taken action to remove the drink from state stores. Eatocracy's own home base of New York will stop receiving shipments of the controversial "blackout in a can" on December 10.
With the impending Food and Drug Administration ban, Phusion Products, the beverage company behind Four Loko released the following statement late Tuesday evening:
Phusion Projects today announced the company’s intent to reformulate its products to remove caffeine, guarana and taurine nationwide, saying it has taken the necessary steps to do so and is informing its employees and distributors of the plans. Going forward, Phusion will produce only non-caffeinated versions of Four Loko.

It's not banned automatically, but the companies need to either reformulate them without caffeine or pull the product entirely.

I picked up a can of the fruit punch Four Loko just to see what all the fuss was about. I plan on drinking it this weekend.

This Fark.com thread has some funny stuff in it.
http://www.fark.com/cgi/comments.pl?IDLink=5726877&hl=Introducing-this-seasons-designated-panic-drink-Dont-leave-home-without-an-unfounded-opinion-about-it
*Protip: If you're going to drink Four Loko, get the Lemonade. Don't bother with any other flavor. You might be thinking, "Watermelon sounds good." No. Imagine a watermelon jolly rancher. Now imagine stuffing that watermelon jolly rancher up a hobo's ass, pulling it back out, and sticking it in your mouth. THAT'S watermelon Four Loko
*Taste: Heavy and syrupy, with a stale, bitter aftertaste. Like sucking on a clown's dick. Not as revolting as Thunderbird but it coats the mouth like MD 20/20.
*I can't begin to explain the aftertaste, it's like a cat ate half a dozen double-A batteries and then wiped it's abscessed asshole across my tongue.
Etc.

Straight from fda.gov.
Update on Caffeinated Alcoholic Beverages
FDA Announces Progress on Removal of Certain Caffeinated Alcoholic Beverages from the Market
On November 17, 2010, the FDA issued Warning Letters to four manufacturers of caffeinated alcoholic beverages. FDA’s letters warned that the addition of caffeine to those manufacturers’ alcoholic beverages has not been approved by FDA and is an “unsafe food additive.” The four manufacturers to receive Warning Letters were Phusion Projects, LLC, United Brands Co., Inc., Charge Beverages Corp., Inc., and New Century Brewing Co., LLC.
Since issuing the Warning Letters, the FDA has had discussions with all four companies. As a result of those discussions, significant progress has been made.
Phusion Projects has advised the FDA that it has ceased producing caffeinated alcoholic beverages, is no longer shipping such products, and expects to have all of its caffeinated alcoholic beverages off retail store shelves by December 13. Phusion Projects is the maker of Four Loko.
United Brands has informed FDA that it has ceased shipping its caffeinated alcoholic beverage Joose and, similarly, expects to have its product off retail store shelves by December 13. United Brands also informed FDA that it no longer markets Max, another caffeinated alcoholic beverage listed in the Warning Letter.
Charge Beverages has notified FDA that it ceased producing its caffeinated alcoholic beverages, Core High Gravity HG, Core High Gravity HG Orange, and Lemon Lime Core Spiked, in September and has not shipped any caffeinated alcoholic beverages since early November.
New Century Brewing has advised the FDA that it has ceased manufacturing its caffeinated alcoholic beverage, Moonshot.
.........Now its offically done with. Except you can still buy them while stores still have them. next batch will be non-caffeine versions.
